S. 3804, the Combating Online Infringement and Counterfeits Act (COICA), seeks to curb infringement by so-called “rogue websites” wholly dedicated to promoting infringing activities. Despite that worthy goal, the bill’s provisions raise several complex legal, political, and technical issues. If these issues are not resolved, they could cause drastic harm to consumers, educational institutions, small businesses, innovative technologies, free speech and global Internet freedom.
The nature of the remedies proposed in the bill, including the seizure of domain names and the blocking of Domain Name System (DNS) requests, raises substantial concerns about the bill's impact on free speech and the First Amendment.
