This would be funny, given how Fairpoint has become the poster child for the failure of the private sector to deliver on its big promises to rural communities. But Fairpoint's talking points have ended up in legislation filed by Maine State Senator Lisa Marrache (D-Waterville) and Maine State Rep.

As a result of this lack of competition, consumers end up paying high prices for limited devices.

There is great background for this “Evolution waiver” (named after the company that originally requested it – Evolution, Inc. - not because anything is evolving) here, so I won’t rehash all of the details.
The short version is that the FCC thought it needed to waive its existing rules designed to create competition in cable set-top boxes in order to make sure that low-cost set-top boxes were available.

“Earlier today, Comcast issued a five-page
letter which was supposed to address 'public interest' concerns about
the merger with NBCU. The letter is irrelevant to our concerns, and did
not address them at all.
“The letter said only that Comcast would obey existing programming
access requirements (which don't apply to terrestrially distributed
programming), and would comply with requirements for programming for
children. It made no mention of making programming available to other
online providers.
The following statement is attributed to Gigi B. Sohn, president and
co-founder of Public Knowledge:
“We have serious doubts whether this merger is in the public
interest. It raises substantial and complex competition issues across
multiple types of media.
“The combination of the country’s largest cable company, a TV
network and a movie studio could present grave dangers to a free and open
Internet. The sheer size of the transaction makes a Net Neutrality rule
that much more necessary, as more content comes under the control of
another giant media company. Regulators will have to make certain that
Comcast does not give advantage to NBC programs and films over others.
Public Knowledge just filed comments urging the FCC to pay close attention to a study (PDF) it commissioned on broadband unbundling. The study, written by Yochai Benkler and his team at Harvard’s Berkman Center, examined international broadband regulatory practices.

Mon. in comments on Internet policy recommended by a study done for the
Federal Communications Commission by the Berkman Center for Internet and

Late on Friday, a federal court in New York received a new version of the Google Book Search settlement. As with the old version, the new one was drafted jointly by Google and its erstwhile litigation opponents: the publishers and authors who sued Google for scanning their books without permission.
Substantively, the new settlement bears a great resemblance to the old one.
