Sneaking 3 Horrible Wireless Ideas into One Bill

Here in Washington, a classic way to get a bad policy passed is to attach it to the back of some unrelated “must pass” piece of legislation. Attaching one bad idea to a bill is sneaky.  Attaching two bad ideas is bold.  Attaching three?  Well, that’s what we have with a trio of horrible wireless ideas that some people in Congress are trying to attach to the upcoming Payroll Tax bill.

It is almost as if the proponents of these additions took a few years’ worth of ideas that will make wireless worse, wrapped them up in a bundle, and glued them to the underside of a bill that – if it does not pass – will raise taxes for millions of Americans.  In this case, these conditions would apply to spectrum freed up by the transition to digital TV broadcasting, and would impact some of the most useful spectrum to become available for years.  What are these conditions?

Thomas Friedman writes in his column yesterday that none of the Republican candidates has focused much on technological innovation, then proceeds to focus on the matter of “smart cities.” Friedman’s thesis is fairly straightforward: to maintain our competitive edge, we will need to keep pumping up our bandwidth, particularly in cities and towns which historically act as the incubators for The Next Big Thing and all its associated, Highly Useful Little Things. Blair Levin’s Gig U gets favorable mention, and Blair gets quoted a lot on why we want huge bandwidth in urban areas as well as making sure everyone gets access to functional broadband.

Handset Exclusivity

Handset exclusivity is a common practice by mobile cell phone carriers—so common, in fact, that most people may take it for granted. “Handset exclusivity” happens when mobile networks make exclusive, anti-competitive deals with device manufacturers. Think iPhone/AT&T (and now also Verizon), Droid/Verizon, and Palm Pre/Sprint.

“Handset exclusivity” hearkens back to the days when you had to rent your landline phone from the telephone companies. The practice severely limits consumer choice over devices and providers.

Imagine if, instead, you could have any phone on any network. The competition this would create would inevitably lead to greater innovation, lower costs, and better data plans.

Freedom to Text

The convenience and low overhead of text messages have made them vitally important—in emergencies, and in spreading the word on important, time-sensitive issues. Text messages to loved ones can get through even when voice networks are overwhelmed. Businesses can use text messages to alert their best customers to special offers. Text messages can also be used to alert the public about dangerous situations or urge political action.

However, mobile carriers currently can and do discriminate in who is allowed to send and receive text messages.

This is because mobile carriers have complete discretion over something called short codes. You know short codes: “Text ‘HAITI’ to 90999 to donate $10 to Red Cross relief efforts” – that 90999 is called a short code. It’s not a normal 10-digit phone number. Short codes are the only way an organization or company can send or receive text messages.

Data Caps

Internet data caps are monthly limits on the amount of data you can use over your Internet connection. When an Internet user hits that limit, different network operators engage in different actions, including slowing down data speeds, charging overage fees, and even disconnecting a subscriber. These caps come into play when a user either uploads or downloads data. Caps are most restrictive for wireless Internet access, but wired Internet access providers are also imposing these caps.

Whatever the variation of data cap, they all have the same effect—they discourage the use of the Internet and the innovative applications it spawns.
