Public Knowledge Tracks Secretive Trade Talks

On May 8, the latest negotiating session for the latest secretive trade agreement will start in Dallas and continue for two weeks.  The Transpacific Partnership Agreement (TPP) is a wide-ranging agreement being negotiated by the U.S. and eight countries, Australia, Brunei Darussalam, Chile, Malaysia, New Zealand, Peru, Singapore, and Vietnam.

Like its predecessor, the Anti-Counterfeiting Trade Agreement (ACTA), most of the work is being done behind doors closed to the general public.  Also like ACTA, there could be severe harmful effects on copyright law.  (Unlike ACTA, at some point the agreement will be considered by Congress.)

From Colombia to the TPP: Calling for an End to Unbalanced IP Exportation

Monday morning a group of nearly 70 international intellectual property academics and experts wrote to the Colombian legislature “in response to what we perceive as a hurried process to implement the provisions of the U.S.-Colombia Free Trade Agreement (FTA) through amendments to Colombian law that may not fully take into account the importance of balance in a healthy copyright system.”

The letter specifically notes that the group of experts reviewed the recently released Copyright reform bill in Colombia and

TPP Tranparency Problems Keep Getting Worse

The Trans-Pacific Partnership Agreement (TPP) negotiation shuts out public participation and we have written extensively about why that is a problem. The agency leading the negotiation, the Office of the United States Trade Representative (USTR), however, seems completely oblivious to these problems, arguing instead that it has given opportunities to all stakeholders to present their views. The mere opportunity to present our views to the USTR, without more, does not cure problems with TPP’s process. However, it provides us with a minuscule opportunity to influence its outcome.

Tell the White House to Ensure Openness in the TPP's IP Chapter

Dear President Obama, 

The process by which the Trans-Pacific Partnership Agreement (TPP) is being negotiated suffers from a democracy deficit that undermines its legitimacy.

This secretive process is not consistent with your administration's commitment to open government and is particularly problematic when chapters of the trade agreement, like the intellectual property chapter, negatively impact domestic policy.

In previous posts, I have talked about various problems with the Transpacific Partnership Agreement’s (TPP) intellectual property (IP) chapter, the sequel to ACTA. Many of these problems could be solved with greater transparency. Yet the Office of the United States Trade Representative seems comfortable with this secrecy arguing that trade agreements cannot be negotiated any other way. They also assure us that they would not pursue provisions that are inconsistent with U.S. law. Yet, if history is any guide, they very well might be.

TPP Negotiations Reveal Chink in U.S.’s Armor

Yet given the power of the U.S. as a negotiator and the eagerness of the other countries to gain access to U.S. markets, it appeared that the U.S. could ram this text down the throats of the other countries. However, there seems to be a small chink in the U.S.’s armor.

As I’ve written before, negotiations for the Transpacific Partnership Agreement (TPP) are secret and we don’t know much about what’s in it. What we do know gives us cause for concern.

It appears from a text that leaked a year ago that the United States is pushing a copyright chapter that significantly compromises your ability to communicate on the Internet. Yet given the power of the U.S. as a negotiator and the eagerness of the other countries to gain access to U.S. markets, it appeared that the U.S. could ram this text down the throats of the other countries. However, there seems to be a small chink in the U.S.’s armor.

Yesterday, I attended the Senate Finance Committee Hearing on the President’s 2012 Trade Agenda. United States Trade Representative Ambassador Ron Kirk was the sole witness and testified on behalf of the Administration. The hearing was an opportunity for UTSR to soothe public concerns and address the recent scrutiny it’s received for the secretive negotiation process surrounding TPP negotiations. Instead the USTR failed to seriously address the lack of public input within negotiations.
